Terms of service

Encore Flights (“Encore”, “we”) is a service of Encore Diversified, 10105 E Via Linda, Ste 103-1183, Scottsdale, AZ 85258. We operate a marketplace that connects travelers with FAA-certificated Part 135 air carriers.

Encore is not an air carrier and does not own, operate, lease or control any aircraft. We act as your agent in arranging charter transportation. Every flight arranged through Encore is performed by an independent, FAA-certificated direct air carrier who exercises full operational control over that flight — including all decisions about airworthiness, crew, routing, weather, and whether the flight departs at all.

When you submit a request you state a maximum price per seat. That maximum is a binding offer: if a flight clears at or below it during your travel window, you authorise us to charge your card for the clearing price plus the service fee.

The clearing price is calculated as described on our How it works page: a single uniform price paid by everyone seated on the flight, equal to the operator's accepted charter total divided by the seats sold. It will never exceed the maximum you set, and frequently comes in below it.

You may raise your maximum or cancel your request at any time before a flight matches. You may not lower your maximum, because operators price against the demand on the board and a ceiling that can be walked back is not demand.

Your card is stored when you make a request and is not charged, held or authorised until an operator accepts a flight that includes you. At that moment we charge the clearing price for your seats plus Encore's service fee (8% of the seat price, subject to a per-seat minimum shown on our Pricing page).

If your card declines when a flight matches, your seat is held while we contact you, but a seat we cannot collect payment for may be released to another traveler.

Before a flight is confirmed: you may cancel at no cost, and your card will not have been charged.

After a flight is confirmed: bookings are non-refundable. When an operator accepts a flight they commit an aircraft, a crew and an airport slot on the strength of the confirmed manifest. Cancellation by you after that point, for any reason, does not entitle you to a refund.

If the flight is cancelled by the operator or by Encore — for weather, mechanical, crew duty limitations, or any other reason — you receive a full refund of everything you paid, including the service fee. This is the only outcome we offer in that case; we do not issue credits in place of refunds.

Nothing here limits an operator's own obligations to you as a passenger, or any rights you have under applicable law that cannot be waived by agreement.

• Give accurate passenger names and contact details. Aviation security requires them, and a wrong name can cost you the flight.
• Arrive at the departure FBO at the time the operator specifies. A private aircraft waits for a schedule, not indefinitely.
• Comply with the operator's requirements on baggage, weight, pets, hazardous materials and conduct. They have the final say and safety reasons for it.
• Hold valid identification and, for any international leg, valid travel documents.

Unless you have booked the whole aircraft, you will be flying with other travelers who booked seats on the same flight. We share your first name and passenger count with the operator for the manifest; we do not publish your identity or contact details to other travelers.

Operators using Encore represent that they hold a current FAA Part 135 certificate, that they hold operational control of the flights they accept, and that they carry insurance appropriate to commercial passenger charter. We check certificate details at enrollment. We do not, and cannot, supervise the day-to-day airworthiness or operational decisions of an independent carrier.

A bid accepted through the platform is a binding commitment by the operator to perform the flight at the charter total bid, subject to the operator's overriding safety authority.

To the fullest extent permitted by law, Encore's aggregate liability arising out of or relating to a flight or booking is limited to the amount you paid Encore for that booking. Encore is not liable for the acts or omissions of an operator, for delays, or for consequential losses such as missed connections, events or business opportunities.

Claims arising from the operation of an aircraft lie against the operator who flew it, not against the agent who arranged the booking.

These terms are governed by the laws of the State of Arizona.
